中文摘要 森林是经济社会发展的重要资源,是法律调整和法理研究的重要对象。文中从总结关于森林概念的多种学说入手,提出了明确森林等相关概念法律意义的建议;在此基础上,从法律关系客体、权利主体、权利内容、权利性质和权利行使5个方面阐释了森林的法律特征;同时对当前我国的森林法律调整实践进行了回顾,并以《森林法》修改为例从4个方面对我国的森林立法提出了具体意见和建议。

英文摘要 Forest is the important resources for economic and social development, as well as the key object of legislation adjustment and jurisprudential research. The author started from the study of the concepts of forest to explicitly come up with the suggestion that the conceptual legal meaning concerning forest should be specified. Based on this, the legal features of forest were expounded from 5 aspects, i. e., legal nature, subject of right, content of right, nature of right and perform of right. At the same time, the author reviewed China's current practices of legislation adjustment, and also provided the specific comments and suggestions on the forest legislation from 4 aspects with the amendment of The Forest Law as an example.
